In Delva v. State, 557 So.2d 52 (Fla. 3d DCA 1989), the district court of appeal reversed Delvas conviction for trafficking in cocaine because the trial court did not instruct the jury on an element of the crime, i.e., Delvas knowledge that the substance was cocaine. In an unpublished order denying rehearing, the court certified the following question as being of great public importance:
